These Terms of Service (“Terms”) govern purchases from Zus & Zo, whether made in-store and, where available, through our website (the “Website”). By placing an order or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

By purchasing from us, you confirm that you have the legal capacity to enter into a binding agreement and that the information you provide (including contact details, where applicable) is accurate, current, and complete.

3. Products and Availability

We take reasonable steps to ensure that product descriptions, sizing, and imagery are accurate. However:

Product colors and appearance may vary due to screen settings, lighting, and photography.

Availability is not guaranteed. We may limit quantities, discontinue products, or change product offerings at any time.

4. Pricing and Currency

Prices are displayed in ANG/XCG unless stated otherwise. Prices may be changed at any time without prior notice. Applicable taxes and fees will be included in the price or added at checkout, as required.

4A. Errors and Inaccuracies

We take reasonable care to ensure that product information and prices displayed in-store and on the Website are accurate. However, errors may occur, including typographical, printing, pricing, or other inadvertent inaccuracies (“Errors”).
In the event of an Error, we reserve the right to correct the Error and, where applicable, to refuse, cancel, or limit any order or purchase affected by the Error, even if an order confirmation has been issued. If payment has already been processed for an online order we cancel due to an Error, we will issue a reversal or refund in accordance with the payment provider’s procedures.

5. Online Orders and Payment

Where online ordering is available:

An online order is considered accepted/confirmed only when payment has been successfully processed and you have received an order confirmation from us.

We reserve the right to refuse, cancel, or limit any order, including due to suspected fraud, stock limitations, or Errors (see Section 4A).

If an online order is cancelled after payment, we will issue a reversal or refund in accordance with the payment provider’s procedures.

6. In-Store Collection Only

All purchases must be collected in-store. We do not offer shipping or delivery.
Where online ordering is available, you will be notified when your order is ready for collection.

You are responsible for collecting your order within any stated collection timeframe communicated at checkout or in the order confirmation (if applicable).

Risk of loss transfers to you when the items are handed over to you or your authorised representative in-store.

7. Returns, Exchanges, and Refunds

All sales are final. We do not provide refunds after purchase, except where required by applicable law or where we cancel an online order after payment (see Sections 4A and 5).

Exchanges (in-store): Exchanges are permitted within three (3) days of purchase only if:

The original official receipt is presented; and

The item is unused, unworn, unwashed, and in original condition, including tags and packaging where applicable.

We reserve the right to refuse an exchange if:

The three-day exchange period has expired;

The official receipt is not provided; or

The item shows signs of wear, damage, washing, odours, staining, or alteration.

Hygiene exclusions: For hygiene reasons, certain items may be excluded from exchange (e.g., swimwear, earrings, and intimate items), unless applicable law requires otherwise.

8. Promotions, Discounts, and Gift Cards

Promotions and discounts apply only during the stated period and under the stated conditions. Discounts cannot be combined unless expressly stated.
Gift cards and/or store credit, if offered, are non-refundable and may be subject to validity/expiry rules to the extent permitted by law.

9. Customer Conduct

We reserve the right to refuse service or restrict access where a customer engages in abusive, threatening, discriminatory, or otherwise inappropriate behaviour, attempts theft or fraud, or disrupts store operations.

10. Intellectual Property

All content on the Website and our social media channels, including logos, photographs, and text, is owned by us or used under licence. You may not copy, reproduce, distribute, or use any content for commercial purposes without prior written consent.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential losses arising from the use of our products, services, or the Website. Our total liability for any claim relating to a purchase will not exceed the amount paid for the specific item giving rise to the claim.
Nothing in these Terms limits consumer rights that cannot be excluded under applicable law.

12. Privacy

Where we collect personal data (including for online orders, customer service, or marketing), we will process such data in accordance with applicable requirements and any published Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of purchase will apply to that transaction.

14. Governing Law and Disputes

These Terms are governed by the laws applicable in Curaçao. Any disputes will be submitted to the competent courts of Curaçao, unless mandatory consumer protection rules provide otherwise.
